The Council of ICAI considering the request from Members at large has decided to extend the last date for payment of Membership/ COP fee from 30th September, 2020 to 30th November, 2020.

1. Time Limit of Company Fresh Start Scheme, 2020 has been extended till 31.12.2020 from 30.09.2020 earlier.

2. Time Limit of LLP Settlement Scheme, 2020 has been extended till 31.12.2020 from 30.09.2020 earlier.

3. The “deemed event date” of Charge creation and modification during the COVID period has been extended till 31.12.2020.

4. DPT-3, DIR-3KYC E-Form/Web form and INC-22A (Active) were originally part of the CFSS. So, as per our understanding due dates of these forms also extended.

CBDT Extended the deadline for filing of income tax return for the Financial Year 2018-2019 from 30-09-2020 to 30-11-2020

 

CBDT HAS FURTHER EXTENDED THE DEADLINE  FOR FURNISHING OF INCOME TAX RETURN FOR THE FINANCIAL YEAR 2018-2019 FROM 30TH SEPTEMBER 2020 TO 30TH NOVEMBER 2020.


On further consideration of genuine difficulties being faced by taxpayers due to the Covid-19 situation, CBDT further extends the due date for furnishing of belated & revised ITRs for Assessment Yr 2019-20 from 30th September, 2020 to 30th November, 2020.Order u/s 119(2a) issued.

Extension in filing of GSTR-9 and GSTR-9C of Financial Year 2018-2019 from 30-09-2020 to 31-10-2020

GOVERNMENT HAS EXTENDED THE DUE DATE FOR FURNISHING OF ANNUAL RETURN IN  FORM GSTR-9 AND GSTR-9C FOR THE FINANCIAL YEAR 2018-2019 FROM 30TH SEPTEMBER 2020 TO 31ST OCTOBER 2020.


After obtaining due clearances from the Election Commission in view of the Model Code of Conduct, Government has extended due date for furnishing Annual Return in GSTR-9 and GSTR 9C for 2018-19 from 30.09.2020 to 31.10.2020.

REQUIREMENT OF FILING OF ANNUAL RETURN IN FORM GSTR-9 AND FORM GSTR-9C FOR THE FINANCIAL YEAR 2018-2019:


A. TURNOVER UPTO RS. 2 CRORE IN FINANCIAL YEAR 2018-2019:

FILING OF FORM GSTR-9 AND GSTR-9C ARE OPTIONAL.


B. TURNOVER EXCEEDING RS. 2 CRORE BUT UPTO RS. 5 CRORE IN FINANCIAL YEAR 2018-2019:

FILING OF FORM GSTR-9 IS MANDATORY BUT FILING OF FORM GSTR-9C IS OPTIONAL.


C. TURNOVER EXCEEDING RS. 5 CRORE IN FINANCIAL YEAR 2018-2019:

Lok Sabha passes The Taxation and Other Laws (Relaxation and Amendment of Certain Provisions) Bill, 2020 

The lower house of the Parliament, the Lok Sabha has passed Lok Sabha passes The Taxation and Other Laws (Relaxation and Amendment of Certain Provisions) Bill, 2020. 


As per bill there is no extension of due dates of income tax and audit reports. The dates stand at 30th September 2020 for AY 2019-20 , 30th November 2020 for AY 2020-21 and for Audit reports 31st October 2020.


NO EXTENSION

The amended taxation bill passed by loksabha. The ambiguity of language created an impression that dates for filing ITRs etc has been extended. However that is not true. 

The bill starts from third proviso of section 3 which is as under:

“Provided also that where the specified Act is the Income-tax Act, 1961 and the compliance relates to—

(i) furnishing of return under section 139 thereof, for the assessment year commencing on the

(a) 1st day of April, 2019, the provision of this sub-section shall have the effect as if for the figures, letters and words “31st day of March, 2021”, the figures, letters and words “30th day of September, 2020” had been substituted;

(b) 1st day of April, 2020, the provision of this sub-section shall have the effect as if for the figures, letters and words “31st day of March, 2021”, the figures, letters and words “30th day of November, 2020” had been substituted;

(vii) furnishing of report of audit under any provision thereof for the assessment year commencing on the 1st day of April, 2020, the provision of this sub-section shall have the effect as if for the figures, letters and words “31st day of March, 2021”, the figures, letters and words “31st day of October, 2020” had been substituted:“

 

Now after reading the above amendments many believed for once that due date have been extended to 31 March 2021 for all income tax returns and tax audit reports.

However, that’s not true. If one reads the above bill carefully the first sub section extends all the due date between 20 March 2020 to 31 December 2020 to 31 March 2021 whereas the next proviso clarifies that for various due dates shall not extend to 31 March 2021 where it will extend to some specific date. For eg:

1. Due date for return of A.Y. 2019-20 will be 30 September 2020 instead of 31 March 2021.

2. Due date for return of A.Y. 2020-21 u/s 139(1) will be 30 November 2020 instead of 31 March 2021.

3. Due date for tax audit report for A.Y. 2020-21 will be 31 October 2020 instead of 31 March 2021.

Thus there is no extension as on 19 September 2020 for ITR filing or Tax Audit Due date.

Minimum recommended scale of Professional Fees by ICAI


The Institute of Chartered Accountants of India, New Delhi has recommended the minimum scale of Professional Fees to be charged by the Chartered Accountants for various professional services. The list of provided on the basis of Category of Cities and Grouped by Nature of Professional Assignment.

Main features of Minimum Recommended scale of Professional Fees are us under:

1. Fees to be charged depending on the complexity and the time spent on the particular assignment.

2.The below recommended minimum scale of fees is as recommended by the Committee for Capacity Building of Members in Practice (CCBMP) of ICAI.

3. The below table states recommendatory minimum scale of fees works out by taking into account average time required to complete such assignments.  However, members are free to charge varying rates depending upon the nature and complexity of assignment and time involved in completing the same.

4.Office time spent in travelling & out-of-pocket expenses would be chargeable. The Committee issues for general information the above recommended scale of fees which it considers reasonable under present conditions. It will be appreciated that the actual fees charged in individual cases will be matter of agreement between the member and the client.

5. GST should be collected separately wherever applicable

6. The Committee also recommends that the bill for each service should be raised separately and immediately after the services are rendered.

7. Class A Cities here includes Delhi, Mumbai, Calcutta, Chennai, Pune, Hyderabad, Bangalore and Ahmedabad. Class B Cities includes all other cities not included in “Class A”.

8.The amount charged will be based on the location of the service provider.
